According to the Abilene Reporter-News, a chaotic scene involving at least six vehicles, including two tractor-trailers, resulted in the death of two young girls. The accidents occurred on Interstate 20 at around 8:30 a.m. on a Friday earlier this month.
Investigators determined the initial incident, which happened in the westbound lanes between the exits for Loop 322 and the East Business 80, involved a 1-ton utility vehicle. The driver of the truck lost control of the vehicle after its rear axle sheared off, and it rolled over into the embankment lining the westbound lanes.
A local police officer who was attempting to slow down traffic east of the scene claims he saw the subsequent collisions that resulted from the congestion. Tragically, one of the crashes proved to be fatal.
When a pickup truck rear-ended a stopped car, the force of impact was enough to cause fatal injuries to the car’s two passengers, an 11-year-old girl and her 14-year-old sister. The driver of the car, the girls’ mother, sustained non-life threatening injuries and was transported to a hospital for treatment. Abilene police diverted traffic for several hours in order to investigate the wrecks and clear the scene.

Can Parents Sue Negligent Parties for the Wrongful Death of Their Children in the State of Texas?
Wrongful death lawsuits aim to compensate family members for the accidental death of a loved one. For example, if a man sustains fatal injuries as the result of hazardous conditions at work, his wife and children could hold his employer financially accountable for lost income and benefits.
Since parents do not typically rely on children for financial support, there is some confusion as to whether they can file a wrongful death claim following the death of a son or daughter. In the state of Texas, parents who lose a child in a preventable accident have the right to bring a suit against the reckless or negligent party who caused it.
When calculating a fair settlement, they can include compensation for damages like:
- Funeral expenses and burial costs;
- Medical bills accumulated prior to the death; and
- Pain and suffering.
In certain cases, the state of Texas also allows wrongful death claimants to recover punitive damages. Typically, such damages are capped at $200,000 or twice the economic costs plus the non-economic costs of up to $750,000, whichever is greater.
